INTRODUCTION

1.1     Your agreement is with your Caroline Louise Dingwall (‘the Teacher’ ) who will provide you with  pilates training. These Terms and Conditions form part of your agreement with the Teacher.

1.2     Your instructions to commence pilates training will constitute acceptance of these Terms and Conditions when you will become a client (the ‘Client’ or ‘you’). You are asked to pay special attention to the provisions related to cancellations.

TEACHER’S OBLIGATIONS

2.1     The Teacher will use her skills and knowledge to design a safe programme of pilates training that will take into account your lifestyle, personal goals, fitness levels and medical history.

2.2     The Teacher will provide the instruction, coaching, supervision, advice, and support that you will need to achieve your goals.

2.3     Each pilates training session (‘a Session’) will last approximately 60 minutes unless otherwise agreed However, the first Session will also include a postural analysis and administration and will consequently last approximately 75-90 minutes.

2.4     You understand that the results of any pilates training programme cannot be guaranteed. Your progress depends on your effort and co-operation in and outside of the Sessions. You acknowledge that individual results may vary and that no particular result is guaranteed by the  Teacher

2.5     All Client information will be kept strictly private and confidential.

CLIENT’S OBLIGATIONS

3.1     It is understood between you and the Teacher that both must commit to your training programme 100% in order for you to achieve results.
 
3.2     You are required to arrive on time for each Session so that the Teachers’ full training plan is achieved on each visit.
 
3.3     You are required to wear appropriate clothing, including grip socks, at each Session.
 
3.4     You are required to sign the Provision of Service Agreement before undertaking your first pilates training session. This is not applicable to trial sessions.
 
3.5     The Teacher may require a letter of ‘medical clearance’ from your Doctor. Please be aware that your Doctor may charge for providing this letter.
 
3.6     You understand and agree that it is your responsibility to inform the Teacher of any conditions, or changes to your health, now and ongoing, which might affect your ability to exercise safely and with minimal risk of injury.
 
3.7     You may need to provide further medical information from a medical practitioner should the Teacher require it in order to conduct pilates training safely.
 
CANCELLATION AND REFUND POLICY
 
4.1.    Cancellations should be made at least 24 hours before a Session.
 
LATENESS POLICY
 
5.1     If the Client is late for a Session, it cannot be extended and will end at the appointed time. In exceptional circumstances, and at the sole discretion of the Teacher, a Session may be extended to the full 60 minS.
 
5.2     If the Client arrives more than 15 minutes late for a scheduled Session without informing the Teacher, the Teacher may have left the premises, and the Session will be cancelled / forfeited.
 
5.3     If the Teacher is late for a Session, the Session will be extended to the full 60 minutes.
 
HEALTH AND SAFETY
 
6.1     The Teacher is registered on the Register of Exercise Professionals (REPs) UAE and consequently holds a current certificate for emergency first aid.
 
6.2     If the Teacher conducts a Sessions  on your premises, you are responsible for providing a safe exercise environment.
 
GENERAL
 
7.1     You understand that in the unlikely event of the Teacher being unable to continue your training for any reason, you can request a full refund for any unfulfilled pack sessions.
 
7.2     The Teacher has the right to change these Terms and Conditions, for example, to be able to offer new services or as required by law. The Teacher will notify you of any changes. When such changes are made, if dissatisfied, you can cancel this agreement once you have made any payments due to the Teacher.  Alternatively, if you cancel this agreement, you can request a full refund for any unfulfilled pack Sessions.

Provision of service agreement

DECLARATIONS

1.1    This Agreement is entered into between Caroline Louise Dingwall (‘the Teacher’) and the undersigned (‘the Client’). The provision of pilates training, which includes both mat and reformer pilates, by the Teacher to the Client, and Client’s use of any premises, facilities or equipment are contingent upon this Agreement.

ASSUMPTION OF RISK

2.1     The Client acknowledges that they are voluntarily participating in the pilates training provided by the Teacher.

2.2     The Client understands that pilates training is physical exercise, which, by its very nature, carries with it certain inherent risks, including but not limited to physical injury, strain, discomfort, and even the possibility of serious injury or death. This includes injury or damage sustained while and/or resulting from using any equipment, whether provided to the Client by Teacher or otherwise, including injuries or damages arising out of the negligence of Teacher, whether active or passive, or any of Teacher’s associated companies, employees, agents, representatives, and assigns.

2.3     The Client hereby assume all risks and responsibility for any such injuries or other medical incidents.

MEDICAL REPRESENTATION

3.1   The Client warrants and represents that they are in good physical condition and that they know of no medical, or other reason, why they are not capable of engaging in a pilates training, and that such pilates training would not be detrimental to their health, safety, comfort, or physical condition.

3.2     The Client’s agrees to inform the Teacher, in writing, of any change in physical condition or mental state that might affect the Client’s ability to engage safely in pilates training. This includes, but is not limited to, pregnancy.

3.3     The Client agrees not to undertake pilates training whilst suffering from any infections or contagious illness, disease, or other ailment such as open cuts, abrasions, open sores, or minor infection, where there is a risk which is detrimental to the health, safety, comfort, or physical condition of the Teacher.

CONSENT TO MEDICAL TREATMENT

4.1    The Client consents to receive any necessary medical treatment (including emergency First Aid) resulting from the Client’s participation in pilates training.

4.2     The Client agrees to bear all costs associated with such medical treatment.

4.3     The Client agrees to provide the Teacher with the details of an emergency point of contact.

LIMITATION OF LIABILITY

5.1     In consideration of being allowed to participate in pilates training provided by the Teacher, the Client agrees that:

5.1.1     The Teacher accepts no responsibility for loss or damage to the Client’s properties, or for death or injuries sustained while taking part in pilates training provided by the Teacher at any location.

5.1.2   The Teacher and her associated companies, employees, agents, representatives, and assigns shall not be responsible for any claims, demands, injuries, damages, or actions for negligence arising on account of death or due to injury, loss, damage, or theft of the Client’s personal property arising out of or in connection with pilates training provided by the Teacher at any location.

5.1.3     The Client hereby holds the Teacher and her associated companies, employees, agents, representatives, and assigns, harmless from all claims which may be brought against them or on a Client’s behalf for any such injuries or claims aforesaid.

5.1.4    No claims will be made against the Teacher, and her associated companies, employees, representatives, and assigns, for any reason whatsoever by the Client, or on behalf of the Client.

INDEMNITY

6.1.     The Client hereby agrees to indemnify and hold harmless the Teacher from any loss, liability, damage, or cost the Teacher may incur due to the provision of pilates training by the Teacher to the Client.

ACKNOWLEDGEMENT

7.1     The Client expressly agrees that the foregoing agreement is intended to be as broad and inclusive as permitted by the law in the United Arab Emirates and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
